Dutch Road Haulier Temporarily Loses EU Community Licence After Exceeding ERRU Threshold<\/h1>\n

\n A road transport company based in the Netherlands has become the first\n operator in the country to lose its EU community licence solely because\n it exceeded the infringement threshold in the European Register of Road\n Transport Undertakings (ERRU). The decision was announced by the Dutch\n licensing authority NIWO following an investigation by the Human\n Environment and Transport Inspectorate (ILT).\n <\/p>\n

\n According to NIWO, the company accumulated such a high number of serious\n infringements that the total ERRU score went far beyond the permissible\n limit. As a result, the authority concluded that the haulier no longer\n met the requirement of \u201cgood repute\u201d \u2013 one of the core conditions for\n holding a community licence.\n <\/p>\n <\/section>\n\n

Sanctions Imposed by the Licensing Authority<\/h2>\n

\n Based on the ERRU assessment, NIWO decided to suspend the company\u2019s\n community licence for six months. In addition, the designated transport\n manager was declared unfit to hold this position for a period of two\n years. The name of the company has not been disclosed publicly.\n <\/p>\n

\n Both sanctions have been temporarily put on hold after the operator filed\n an appeal, and the final court decision is expected in December. How the ERRU System Works<\/h2>\n

\n ERRU \u2013 the European Register of Road Transport Undertakings \u2013 links the\n national registers of licenced transport companies across EU member\n states. \n Since the implementation of Regulation (EU) 2016\/403 and the mobility\n package amendments, infringements are assigned points and grouped into\n three categories: most serious, very serious and serious. These include,\n for example, tachograph manipulation, repeated breaches of driving and\n rest time rules, dangerous overloading or illegal emissions-control\n tampering. The maximum number of points a company may accumulate depends\n on the size of its fleet.\n <\/p>\n

\n When the threshold is exceeded, the licensing authority must reassess the\n company\u2019s good repute. Depending on the outcome, measures can range from\n warnings and corrective plans to suspension or withdrawal of the licence\n and disqualification of the transport manager.\n <\/p>\n <\/section>\n\n

\n Until now, Dutch authorities mainly relied on warnings and corrective\n actions and were reluctant to base the most severe sanctions solely on\n ERRU scores. This latest case signals a shift towards a stricter\n enforcement approach that other EU countries may follow.\n <\/p>\n
